Judge awards $40,233 in car accident case
An Ohio woman, who was injured in a motor vehicle accident, was awarded a $40,233 verdict by a Lucas County judge.
A Lucas County judge awarded a $40,233 verdict to an Ohio woman who was injured in a motor vehicle crash. Upon entering an intersection, the plaintiff was broadsided by the defendant who failed to yield to the right-of-way. The 42-year-old woman was represented by personal injury lawyer Gary Cowan of the Ohio personal injury law firm, Elk & Elk Co. Ltd.
The plaintiff suffered a fractured wrist, which required emergency medical treatment, open reduction with internal fixation and physical therapy. In addition to damages for pain and suffering, the plaintiff also sought lost wages.
Liability was disputed for the crash, with both parties arguing that they had a green light. Both sides presented eyewitnesses to support their versions of the auto accident. Prior to the trial, the Defendant’s insurance carrier made no settlement attempts and the offer was zero.
“The jury found my client and the eyewitnesses who were traveling behind her at the time of the crash to be credible,” Cowan said. “The defendant’s version of the accident was inconsistent.”
The case was tried to the Lucas County Court Common Pleas in Toledo on March 7, 2011. Judge Stacy L. Cook, who presided over the trial, awarded the plaintiff $40,233.
