Environmental Litigation

Cases are brought by the firm on behalf of persons whose properties or other rights have been affected by toxic contamination or pollution.  These cases involve complex scientific issues and thousands of exhibits.  They require enormous financial and staff resources and sometimes take the form of class actions brought in the interest of numerous similarly-situated persons at a time.

 

DuPont Case – West Virginia

• DuPont Co. must pay $251.7 million in damages for its handling of the environmental cleanup near a waste pile by a West Virginia zinc-smelting facility.
• The company negligently created the 60-acre pile including arsenic, lead and cadmium in the town of Spelter, and must pay for medical monitoring of 8,000 residents.
• DuPont must pay to screen residents for decreased renal function, renal failure, lead poisoning, neurocognitive injury and skin, lung, bladder, kidney and stomach cancer.
• Company must pay to clean up the area structures.
• Homes are to be emptied and cleaned, especially attics, and for new air-conditioning ducts to be installed.  Soil also will be replaced at homes nearest the waste pile.
• The process would take about two weeks for each home.
• Residents would have to be moved to hotels during the process.
• DuPont deliberately misled people about the health risks from pollution at a Spelter.
• One of its own attorneys called the massive pile of toxic waste “a troubling site” and a “fiasco” in his private correspondence.
