Martin S. Delahunty III
Marty Delahunty joined Elk & Elk in March of 2002 as a Trial Attorney. He has been litigating personal injury and medical malpractice cases since 1987 and has been lead counsel in over 100 trials.
Marty brings to the table a number of years of experience as a Defense lawyer having worked on behalf of insurance companies before coming to Elk & Elk. He now uses those tactics developed by the insurance companies on the behalf of our clients rather than Defendants.
Marty currently specializes in the practice of serious personal injury including motor vehicle accidents, intentional tort claims against employers and medical malpractice.
Marty graduated from Cleveland Marshall Law School in 1987 with a Juris Doctorate Degree and is a member of the Order of the Barristers having been inducted into that organization in 1987.
He is currently licensed to practice law in the State of Ohio, the United States District Courts for the Northern District of Ohio, the sixth circuit Appellate Court and the United States Tax Court. Attorney Delahunty is also a member of the Ohio State Bar Association, the Cleveland Bar Association and the Cuyahoga County Bar Association.

Client, age 14, was a passenger in a vehicle that made a left hand turn into oncoming traffic, resulting in a collision with a semi. As a result, client suffers severe traumatic brain injury and is dependant on others for the rest of clients life.
Hip Injury Case Settles For $250,000.00
Client, age 48, was the driver of a vehicle that rear-ended another car that pulled out in front. As a result, the client suffered from injuries to the hip, foot, knee, and elbow.
Fractured Ankle in Failure to Hold a Ladder Case Settles for $120,000.00
Client, age 54, was complaining of pain in the tongue on several occasions with a periodontist. The periodontist simply poked around a hard surface on clients tongue, and failed to perform any biopsy on the lesion. Client then consulted an oncologist who did a biopsy and found client had stage 4 tongue cancer. As a result, client completed radiation therapy to fight the cancer. Unfortunately, client is in fear of relapse.
Abdominal Injury Automobile Accident Case Settles For $121,000.00.
Client, age 7, was a passenger in an automobile that was struck by another vehicle. As a result, the client suffered abdominal injuries, internal bruises, and had a small piece of the intestine removed.
Failure to Yield Collision Case Settles For $100,000.00.
Client, age 38, was the passenger of a motorcycle that was hit by another driver failed to yield to a stop sign. As a result, client suffered head injury, right knee laceration, lung injury, broken pelvis and right leg andspleen removal.
Broken Wrist And Ankle In Automobile Accident Case Settles For $165,000.00.
Client, age 53, was the driver of a car that was rear ended. As a result, the client suffered from a fractured wrist and ankle.
Death In Nursing Home Neglect Case Settles For $100,000.00
Daughter of client received a call from nursing home that her mother was dehydrated and not eating but that they were not overly concerned but would take to ER. Client, age 74, is sent directly to ICU. Client suffered dehydration, bed sore to bone, urinary track infection, and sugar over 700, which resulted in death.
Failure to Observe and Treat Swollen Leg in Nursing Home Neglect Case Settles For $95,000.00
Client, age 68, who was being cared for at a nursing home, had complained of a swollen leg. Caretakers failed to report, observe, and treat leg what was later found to be a blood clot.
Fractured Ribs and Contusions in Snow Plow Accident Case Settles for $41,500.00
Client, age 38, was walking through a parking lot when he was struck by a snow plow that was backing up. As a result of the accident, client suffered a severe contusion of the left upper extremity and left chest wall and fractures to the 6th and 7th ribs.

Client, age 54, was the driver in a vehicle that was rear ended. As a result, client suffered a heart contusion, facial hematoma, and injuries to the neck, shoulder, and stomach area.
