Record Setting Verdicts in Rural Ohio

In Adams County, one of the smallest counties in Ohio, a jury was presented the case of our client, John Fleenor, a 52 year old man who suffered a delay in the diagnosis of oral cancer.
The delay caused Mr. Fleenor to suffer and die after an 18 month battle. In settlement discussions, the defense constantly brought up the fact the highest verdict in the history of Adams county to date was $200,000. Following a trial, the jury returned a $1.4 million verdict for Mr. Fleenor’s widow.
In Allen County, our client, Joe Woodruff, a 46 year old man, died of asphyxiation following the loss of his breathing tube after surgery. Due to staffing problems, the closest doctor to replace Mr. Woodruff’s breathing tube was 7 floors away. In the 9 minutes it took to get the doctor to the bedside, Mr. Woodruff had suffocated. Going into trial, the defense argued that Mr. Woodruff’s case was worth less because it was located in a Rural County.
Our Attorneys disagreed and argued that the value of a life in rural Ohio is worth as much as a life in larger counties. The jury agreed with Elk & Elk Attorneys awarding Mr. Woodruff's widow $2,000,000.
