No Fee Unless You Win
How much will I have to pay to hire a medical malpractice attorney?
Nothing. We operate on a contingency fee basis. This means that our fee is based on a percentage of the recovery we win for you. We understand that we represent the working people of Ohio and that our injured clients, in most cases, do not have any extra money to spare when they are injured and oftentimes not able to work. That is why we are committed to providing the best legal, medical, investigative, and financial talent, and finding the best experts in the country to prove our client's injuries and losses. We charge no fee and the client does not have to advance or pay any case expenses unless the client has a successful outcome.
"Most people have a preconceived idea that it costs a lot of money to be represented by a skilled medical malpractice attorney whose main focus is injury law. At Elk & Elk, we take great pride in being able to represent victims of injury who in most cases will pay us nothing unless we have a successful outcome.” - David Elk
Think you can’t afford the best lawyers or experts?
Think Again! At Elk & Elk, we have the resources to hire the leading experts for you, and you pay nothing unless we have a successful outcome in your favor. Our attorneys practice successfully in every court throughout Ohio.
Fee structure
At Elk & Elk, clients are not charged attorney fees if the team loses the case. If the client recovers damages from settlement or a favorable verdict, the attorney receives a fee from the recovery. The medical malpractice attorney's permitted fee varies depending on the county, and even local jurisdictions. The fee is generally based on the contractual agreement between the attorney and the party. The fee is calculated as a share of the eventual damage judgment or settlement won by the client.
Advantages
A contingency fee arrangement provides access to the courts for those who cannot afford to pay the attorneys fees and costs of civil litigation. Contingency fees also provide a powerful motivation to the attorney to work diligently on the client's case. In other types of litigation where clients pay the attorney by the hour for their time, it makes little economic difference to the attorney whether the client has a successful outcome to the litigation.
Finally, because our lawyers assume the financial risk of litigation, the number of speculative or unmeritorious cases may be reduced..
“When you are represented by Elk & Elk, you have our highly trained attorneys and support staff working for you. You can expect your case to be resolved as quickly as possible so you can get back on your feet.” - Art Elk
