Phil joined the Elk & Elk team in August 2007, after working for three northern Ohio law firms. He specializes in the areas of personal injury, medical malpractice, trucking litigation, products liability, nursing home abuse and neglect and general tort law, with an emphasis in catastrophic injury cases. He is a seasoned litigator practicing in all Ohio State and Federal Courts. Phil was made partner at Elk & Elk in 2012.

Settlements and Verdicts:

$6.3 Million Verdict – Medical malpractice results in hypoxic brain injury (October 2009)


$2 Million – Employer intentional tort results in serious injuries (March 2009)

While at work, a crane fell on the Plaintiff, resulting in serious injuries and lost wages. Plaintiff was admitted for intense rehabilitation and surgery.


$785,000 – Slip and fall results in lumbar injury (September 2009)

Plaintiff fell on a wet floor while shopping at a grocery store. The water was present on white flooring and was not visible by shoppers. Plaintiff suffered a lumbar strain.


$450,000 – Nursing home neglect results in broken hip, infection and death (February 2011)


$300,000 – Nursing home neglect results in wrongful death (May 2009)

Plaintiff contracted a urinary tract infection while in the nursing home but was unable to appropriately recognize the signs and symptoms. The condition worsened, ultimately leading to the Plaintiff’s death.


$275,000 – Nursing home neglect results in wrongful death (September 2010)

The 73-year-old Plaintiff was in a nursing home for dementia and strokes. She was required to wear an alarm in case of an emergency so that she could get necessary assistance when needed. The staff failed to put the alarm on her, which led to a cerebral vascular hemorrhage and death after a fall.


$200,000 – Medical malpractice results in wrongful death (January 2011)

The Plaintiff fell out of bed during her hospital stay, which resulted in her death.
