DePuy defends “business decision”

DePuy Orthopaedics says its decision to phase out ASR hip implants was a reflection of declining sales, not safety, despite the 5,000 lawsuits pending against the company.

In 2009, DePuy Orthopaedic’s ASR hip implant was turned down for approval by the U.S. Food and Drug Administration after studies showed it failed prematurely, requiring secondary surgeries for many patients. In order to be approved by the FDA, a medical device must prove to be reasonably safe and effective. In DePuy’s case, it needed to prove that the hip implant was as effective as, or not inferior to, a traditional hip implant.

Yet, Johnson & Johnson insisted the all-metal hip device was safe and continued to be sold overseas. Meanwhile, The New York Times reported that “a companion version [of the hip] was used in 30,000 patients in the United States,” but was recalled in 2010 amid increasing failure rates. (more…)
